The Dangers of Modern Gaming - written by someone who loves gaming

2023.06.02 21:17 CPTpurrfect The Dangers of Modern Gaming - written by someone who loves gaming

Hey fellow siblings and dads,
I love video games, they were always a part of my life. I met a lot of dear friends through them over the years in many different games. And that's why I want to talk about something I positively can describe as disgusting and gross.
Or more accurately: Predatory.
Over the last twenty years the focus of the game industry became more and more towards multiplayer games and away from single player games, and more and more towards multiplayer-centric games.
And I want to focus your attention on the first sentence of the last paragraph - to be precise on "the focus of the game industry". What does that mean? Does that mean that single player games weren't popular anymore? No. Not one bit. It means that the people behind the big publishers (those who pay for the development of most if not all larger games but not necessarily develop them themselves) realized something very important to them: That they can monetize multiplayer games - or as they call them "live services" - far better than single player games.
It isn't that single player games were dead or didn't sell, it is that the game industry wished them dead.
Because what's more effort? Developing a new game, or just putting another 50 skins or so into an existing one? The pay out is probably roughly the same, whether you pay 60 up front or enough people by a handful of those skins so that the average player paid 60. I think you can make an educated guess what is more effort.
But if it was just that I wouldn't have felt the need to make this post. This is truly just the tip of an iceberg I want you to show here.
And for the next part we talk about a concept some of you might be familiar with, but don't worry if you aren't - I'll explain it in detail. The concept in question is a four letter acronym, and it is called
F.O.M.O.
Or spelt out: Fear Of Missing Out. And the name really tells you the whole story what it is about - about the publisher's intentional creation of FOMO within vulnerable users - not all are vulnerable and if count among the ones who aren't affected by this at all, you are truly "one of the lucky ones".
FOMO is about "limited time offers" and I think most who are into gaming can see where this is going:
Rotating storefronts (Fortnite, VALORANT), battle passes (every multiplayer game in existence, seemingly), sales, limited time offers (BUY NOW! ONLY AVAILABLE FOR XX), etc.
To take VALORANT as an example for the first point, imagine you see a cool skin in the shop, but it isn't even the one you really want for the gun - just one that you think is still an "upgrade" over the one you currently use. I mean, sure it isn't the one you really want, but,... who knows when that hits the store shelves? And when I don't buy it now, I still prefer that one over what I currently have, and most-ish others, so... if I don't buy it now, who knows when I can get another skin for that gun that I actually like? Right? Better buy it now, right?
Does that feel remotely familiar? That is pure FOMO. And I don't think it surprises you to learn that this is 100% on purpose. As said earlier: Something I can positively describe as predatory. And the prey, that is the player.
Another concept integral to live services is what is investment - many of them are free to play, so starting them doesn't take a lot of you - just download and install the game, maybe you need to make a new account and you are good to go - great, right? How easy it is to get started. Often you then also get something to make the start smoother, some kind of starter pack, ain't that nice, now you even have some stuff, straight of the bat!
So, now that we are all hopefully a bit more cynical... let me ask you: Why do you think do they give you those things to make the start feel so smooth? Why not just make the experience as a whole smooth and get rid of the "starter pack"? I want to remind you what aspect we are talking about here, once more:
Investment.
Because that way you already have so many nice things you earned from playing the game - stuff you'd usually often have to spent money for or otherwise would take a whole lot longer. Ain't that nice? You can earn stuff by playing. Almost like... a job. But this isn't a job, right? This is FUN, right? This is what you want to invest your time in after work to get it out of the system, to relax.
Fast forward: You are now playing for a couple of hours, maybe this is your second or third day, and the goodies from the starter pack are basically used up. You feel how the dopamine cycle gets stretched and how what you do now isn't fun anymore - it is boring. You really want that experience back you have just a few hours ago, where everything was fun and the dopamine was flowing freely. Well, how nice that in the shop you see this super exclusive starter offer for a really sizeable amount of items, that otherwise would cost you a fortune, for, what is that? 90% off? Just for a few more hours available? Oh boy, better get out the credit card, wouldn't want to miss that, I mean I already played a couple of hours and I had a genuinely good time with it, if that stretches it out for a few more hours, that'd be great, and what's 10 bucks? That's a steal!
So you buy it. And for another few hours, maybe a day, you have a great time, dopamine flows freely again. You enjoy what you are doing. And it was definitely worth the money, right? But then we are back at the point where the experience starts to drag. And the items from the super exclusive starter offer are also nearly gone as well. I mean I could buy items from the shop now, but what earlier was 10 bucks would now be 50, and that's a lot of money,... but I mean I already paid... so... but it's really a lot of money, I could by myself something outside of that game for that. A nice dinner, a good book and maybe still have enough for cinema tickets, but... I already invested money.
So might as well.
-50$
And that brings us to what investment leads us, to be a bit melodramatic about it - you might have noticed I do like being a bit melodramatic - the THIRD HORSEMAN OF THE GAMING-APOCALYPSE...
okay that might've been a bit much, but it really is basically the other side of the same coin as investment:
The Sunk Cost-Fallacy.
Popular in gambling and live services alike, it describes the "in for a penny, in for a pound"-mentality - or in other words, why we just paid 50 bucks for a bunch of crap that will be used up within two hours. Because we already invested those 10 bucks earlier. Because that told our brain "it is okay to invest money into this" and that is a huge flood gate gone. A flood gate certain companies obviously want gone. So we are ready to pay more. And more. And more. Because I mean if we already paid now 60, might as well take the big super deluxe pack for 100 next time, I mean I get 10% more value out of that than if I had bought 2x50 buck packs.
And now let's talk about an element popularized by Fortnite you can basically find in every online game these days, one mentioned earlier already, that unites FOMO, investment and the Sunk Cost-fallacy in one fine package:
Battle Passes.
Basically inescapable in modern multiplayer games, to not aware allow you to earn rewards for a limited time within a battle pass. And for those blissfully unaware, allow me to explain the concept:
A battle pass (BP) is a form of continuous rewards for keep playing the game, you can think of it in a way as a stamp card. Except that this stamp card often has a very limited time during which you need to fill it up to get the payout, as they are usually only active for a very limited amount of time, this differs from game to game, but common durations are between 1 and 3 months. Instead of the stamps you have a separate "battle pass level" (or something called something else that is functionally a separate level), and (usually) two reward tracks - a free one and a paid one. The free one drip feeds you nice rewards every few levels, but the paid one is where it is obviously at: Exclusive cosmetic items you can only find in here (hello FOMO my old friend), other stuff you'd usually have to pay obscene amounts of cash for, etc.
I think you can see how this works already - but there is an extra kicker that makes them worse:
Battle pass progression is often capped per day/week and is usually achieved with missions you do on the side even if you don't plan on doing them.
So even if you aren't interested in the battle pass you still will slowly progress, you will get your free rewards and one day you might just look at it and go "well that's a lot of stuff I'd already get if I buy the premium pass upgrade now" - after all you level the pass as whole, so if you buy it late you still get all the premium rewards for the previous levels immediately. And you better believe that the game will do everything in its power to make sure you see what you could get "for just a handful of bucks".
So you buy the pass. But if you buy the pass, you obviously don't want it to go to waste, now you want all the rewards, right? You want to reach the maximum battle pass level, otherwise you lose out on stuff you paid for, right?!
And now let's go back a few paragraphs: Battle pass progression is often capped per day/week. Can you see why they'd do that? Why they don't just allow you to play 83478 hours non-stop to get everything immediately? Why they want you just to play... a few hours a day. And even if you don't feel like it, you better log in and do your daily missions, right? I mean you don't want to miss out on all the stuff you already paid the money for. Better now also pay the time for it.
And let's go back a few more paragraphs: But this isn't a job, right? I mean, you do your time per day, even if you don't feel like it, to get the rewards,... that does sound an awful lot like a job, suddenly, doesn't it?
And now thanks to battle passes, you can't just quit, I mean you'd at least would want to finish the current battle pass, you paid for it, right? You wouldn't want to waste that money, right? So better finish that one and quit after. And,... oh, what is that? I could PREORDER the next battle pass?! And I get it 40% cheaper? I mean,... I don't really enjoy playing the game that much anymore, but I'd be stupid not to buy it, right?! That's a massive steal! I can't let such an opportunity pass me by!
And as said, that's not one game that's doing that. It's most of them. They compete for your most valuable - no not your money, your time. Imagine if you don't just play one game like that, but multiple, imagine what it does to you.
To those who feel caught reading this: It isn't your fault. You are a victim. And it isn't your fault. You just wanted to spend your precious free time with something you enjoy.
I don't think I surprise anyone at this point that all this very much isn't just by design, but almost the central goal of many of those companies, as this gives them the most recurring revenue and makes sure that even if they have a game that does poorly their other stuff is still active and lines their pockets with cash at the expense of those vulnerable to those mechanisms.
Lastly, for those who want to know more about this a video from 7 years ago at a mobile gaming conference that goes into more detail how most of this works and what tricks are employed, most fitting summed up with a sentence by the speaker: We can talk about the morality of this at the end, if there is time.
And all this is written by me, who loves video games. And it is written, because and not despite me loving video games. I am not saying "don't game" or "forbid your kids to play games" - games can and should be something wonderful. But what I want to do is to inform you about this. So that you know the tricks they try to employ against you. Companies never are your friend, but most video game companies are a special kind of evil.
Much Love
Big Bro (or for the ones who read this older than me - Lil Bro)
P.S.: Feel free to share your stories about similar experiences in the comments, depending on how this post'll do I'll try to read and respond to as many as possible.

2023.06.02 21:01 Able_Possession8736 The third season of the European League of Football is right around the corner!

The European League of Football

Founded in 2020, the European League of Football (ELF) is a professionalized American Football league that kicked off in June 2021. Unlike the former NFL Europe the league focuses on local talents. The league does not consist of clubs, as is common in Europe, but of franchises similar to the NFL.
After the first strong season with eight teams in two Conferences, another even stronger season followed with 12 teams in three Conferences. The upcoming season will start tomorrow on June 3rd 2023 with 17 teams from nine countries.

The Franchises

The third season will have 17 teams from nine countries divided into three Conferences.

Western Conference:
Central Conference:
Eastern Conference:
Notable facts about the franchises:

Thanks to a cooperation with the NFL the ELF is allowed to use the names of old NFL Europe teams. The NFL has no shares or other financial interests in the ELF, they don't own a franchise or something like that. This prevents a situation where the NFL suddenly pulls out and the whole league collapses.
In the next few years the ELF wants to have 24 franchises from more than 10 European countries. The league already announced a new franchise for the 2024 season located in Madrid, Spain.

The games & rules

Every team will play 12 games in a span of 14 weeks with six teams moving on to the playoffs where the champion will be decided in the championship game. The championship game will take place in Duisburg, home of Rhein Fire and the 31.500 seat stadium is expected to be sold out.
In order to promote and support the local players every franchise can only sign 4 US-Players and only 2 of them can be on the field at the same time. There is also a salary cap in order to keep the competitive balance.
The games will be played with NFL Rules with a few exceptions. The league uses the college overtime rule and the XFL Kickoff Rule.
You can find out more about the rules [here].

European League of Football Subreddit: elf

We are a steadily growing community about everything ELF related. We have a good relationship to players, to the league and are a key community when it comes to the ELF.
Throughout the season we will provide Gamethreads as you know them from NFL and similar sport subreddits. We also have User Flairs for each team so you can show everyone who you are rooting for. There will also be AMAs every now and then.
Tomorrow we will have our very first Gamethreads of the season. The first thread will go online at 4PM CEST(GMT+2).
I hope we can welcome some of you over at elf and talk about American Football in Europe.

Where can you watch the ELF?

With the ELF Gamepass you can watch every game of the ELF from all around the world. The league has a cooperation with Endeavor Streaming, who also provide the Gamepass for the NFL, WWE & UFC.

2023.06.02 20:29 KillerPacifist1 On the Edge - Part 1

There is a romantic notion that the greatest discoveries in science are heralded not by a grand “Eureka!” but by the humble “Huh, that’s weird”. That minor but unexpected phenomena, when picked at, often unravel well established theories and bring about vast new understandings.
On a spaceship this notion is patently false.
On a spaceship “Huh, that’s weird” is not humble, it is insidious. A best case scenario “Huh, that’s weird” means hours of troubleshooting to confirm beyond all possible doubt that what is “weird” is only a faulty oxygen sensor and not an indication of the incipient failure of the life support system. Even then, one will spend nights awake wondering if they really did catch the problem and that they are not being slowly poisoned by an unnoticed build-up of carbon dioxide. A worst case scenario “Huh, that’s weird” means a dead ship, all hands lost.
“Huh, that’s weird,” said Ensign Mukami.
Captain Omondi’s hands tensed around the handholds.
Her last “Huh, that’s weird” had her technicians spending three days digging through the ship’s cooling conduits before finding a literal rat’s nest of wires and insulation causing an exhaust vent to overheat. They managed to clear the nest out, but several weeks and dozens of improvised traps later the rat itself had yet to be found. How a rat got on her ship in the first place is likely a mystery she will likely never solve and the mere thought of it scurrying around in her walls still gave her nightmares.
She can only hope to be equally lucky this time.
“Care to be more specific, Ensign Mukami?” Captain Omondi asked as she floated up behind the ensign’s terminal.
“Yes, sorry ma’am!” Ensign Mukami snapped to attention. Or at least as much one could in microgravity. She had clearly still been puzzling through the problem when the captain interrupted her focus. Captain Omondi doubted Ensign Mukami even realized she had invoked that ominous phrase and guessed the apology and salute were simply an automatic response to being caught off guard by a superior officer. The Captain did not like surprising those under her command. Surprises are never welcome on spaceships, but she wasn’t at all bothered if this incident contributed to the rumors growing in the lower ranks that she could read minds and predict the future. It was not unhealthy for a superior officer to have an air of mysticism about them.
“Well ma’am, I was about to send our updated positional telemetries when I noticed some… discrepancies.”
“I will ask again, Ensign Mukami. Care to be more specific?” The captain kept her frosty exterior but inwardly she sighed with relief. Strange instrument data was almost always an “hours of obnoxious troubleshooting” situation rather than an “oh god, we’re all going to die” catastrophe. “Well like I said, it started when I noticed a discrepancy between where our internal accelerometers believe we are and where our NUPRT data tells us we are.”
NUPRT, pronounced “nup-ert” and known by those averse to acronyms as Neptune-Uranus-Pluto Radio Triangulation, was the gold standard for deep space navigation. By tuning into the NUPRTs nearly continuous stream of time-stamped radio pulses, any ship operating in deep space could easily and instantaneously have an accurate fix on its position down to the meter. “So there is something wrong with our accelerometers then,” The captain asserted. NUPRT signal data was both vital and easy (i.e. cheap) to detect. This meant any ship worth its salt had at least one redundant NUPRT navigation system double checking the results from the first and to act as backup should the first break down. The Godwit had four, all physically and digitally firewalled from each other. It was inconceivable all should break down simultaneously.
“That’s what I thought too, but then I checked the actual vector coordinates the two systems were providing us.”
“And?”
Captain Omondi did not like the turn this conversation was taking. What seemed like a potentially straight-forward problem was starting to give her the same crawling feeling she got when she imagined that god damned rat in the walls.
“The accelerometers all tell us that we are on our merry way. That we are heading out of the solar system at two-point-four times the third cosmic velocity. Exactly as we expect.” An uncomfortable strain had entered the ensign’s voice as she started to ramble.
“And the NUPRT data?”
Ensign Mukami gulped. “According to NUPRT, we stopped moving about thirty minutes ago.”
It was such an unexpected thing to hear that the captain just looked dumbly at the Ensign for several seconds before her brain could properly parse the words.
“Stopped?”
“In our tracks, ma’am. Instantaneous, as far as the instruments can discern.”
“Nonsense,” the captain heard herself say.
No conceivable force could have deaccelerated the Godwit from one hundred kilometers per second in such a manner. Even if God’s own hand had reached through the vacuum to stop their motion, the Captain and the Ensign would not be around to muse upon its divine intervention. They would be too busy being the fine red mist mixed amongst the liquified metal that had once been the Godwit’s hull.
“It is nonsense,” Ensign Mukami agreed with uncharacteristic solemnity, “But our pulsar navigation systems and even an optical planetary triangulation agree with the NUPRT data.”
“Have you shown this to navigation?”
“No sir. I wanted to double check, to make sure I wasn’t… making a mistake”
Or going crazy, the she thought to herself
“Your thoroughness is well appreciated, Ensign. I will bring this to the attention of Officer Kioni personally.”
While Captain Omondi’s conscious mind was still working through the full implications of what it had learned, her instincts told her to maintain control of the narrative until she had a better handle on the situation. The most straightforward conclusion; that three independent, quintuple redundant systems all failed in the same bizarre way, was so improbable it almost more likely that the Godwit had inexplicably come to a dead stop in the vacuum of deep space. A nagging thought crawled up from Omondi’s brain stem and into her conscious mind. If fault and fact were both ruled out, only one plausible alternative remained: sabotage.
Captain Omondi was preparing to call Navigation Officer Kioni and Security Officer Njama to a private meeting when she heard Communications Officer Wambui mumble something to herself.
“Huh, that’s weird...”
“Care to be more specific, Officer?” Captain Omondi asked, feeling a strong sense of dread tinged deja vu as she redirected her path with a handhold and floated to the communications officer’s terminal.
“It appears we have lost connection to the communication tight beam linking us with central command.” Wambui said in her terse, matter of fact way.
Omondi’s heartbeat quickened.
“You caught me in the middle of troubleshooting the situation. I’ll have more information for you in a moment---”
But the captain had already sent the encrypted command for a full system lockdown and Wambui was cut off by a blaring alarm. Within three seconds, the minimum amount of time some safety engineer somewhere had deemed it necessary to clear any doorways or hatches, the entire ship violently compartmentalized.
Within moments the Godwit had ceased to be a ship. It was now dozens of isolated cells separated by vacuum tight, magnetically locked doors so impervious it would be more convenient to breach a wall than try to break through them. Access tunnels, crawlways, and vents were similarly sealed. Each room now responsible for its own life support, with the particularly small and crowded rooms only hours away from carbon dioxide poisoning.
All of this was, of course, standard issue safety procedures in the case of a breach. Any ship incapable of compartmentalization was only one micrometeor away from total pressure loss. An absurd risk to take even for the most foolhardy.
What made Omondi’s lockdown different was it isolated the rooms electronically and locked all service panels. This prevented a would-be saboteur from doing further harm to the ship, physical or digital, but also prevented crew from fixing problems or calling for help.
It also gave Omondi the sole authority to lower the lockdown, and for this she hated it deeply. To have a single point of failure, and for that point of failure to be human, was antithetical to everything the last several hundred years of space travel had taught her people. The fact it was absolutely necessary from a security perspective did nothing to assuage her.
“Listen up people!” Omondi called to her bridge crew. It was unnecessary. Shaken by the ear piercing alarm, slammed doors, and locked terminals, everyone had instinctually looked to her.
“In the last five minutes we have lost both navigation and communication systems. Given the circumstances and timing surrounding their failures, I deemed sabotage to be the most likely culprit and, with the authority vested in me as the captain of the Godwit, I have unilaterally invoked a comprehensive security lockdown and with it assumed absolute control of the ship’s systems. Does anyone dissent my decision or my authority to make it?”
As expected, the room remained deathly silent. This was a formality whose main purpose was to inform her immediate crew members what was going on, confirm her actions were following established protocol, and, most importantly, reassure them that she was still sane. Crew in other compartments would simply need to accept their ignorance and swallow their panic for the time being.
She sent a command and the navigation terminal lit up.
“Officer Kioni, I have temporarily granted you access to your terminal again. Ensign Mukami, please get her up to speed on the problems you identified in our navigation systems. Be warned, the terminal will lock again in ten minutes unless I directly intervene.”
This problem required her to put some trust in her crew, but she did not plan on giving any more than absolutely required. It was another protocol she both agreed with and despised.
She sent a second command and the communications terminal flashed blue.
“Officer Wambui, while Ensign Mukami brings Kioni up to speed, let’s see what we can make of our communications problem.” She continued, louder so everyone on the bridge could hear her. “We have roughly three hours to solve this problem before we start to take asphyxiation casualties in the more cramped segments. We will not let that happen.”

2023.06.02 20:28 surfrock66 I'm in need on advice in getting a SharePoint instance I inherited back on the rails.

In the last 6 months, I started at a new org with a massive heap of technical debt. While getting settled, we were hit with ransomware and my leadership contracted with an IT company that came in and made a lot of "security" changes with fairly reckless abandon for how things ended up working for end users. I am specifically charged with restoring the user experience for SharePoint on premises 2019.
Before it comes up, I work for a university with a terrible habit of uploading full videos of lectures directly into SharePoint. When I started, we had multi-terabyte content databases, which I have worked to split off. I say this because the cost of moving to SharePoint online has been determined to be cost prohibitive at this time; it would be double-digit terabytes of storage for their end use case.
We have a hybrid directory, so on-prem AD and then additionally azure AD, and they sync between each other. The Azure AD was implemented by the breach remediation company, so I have limited access and often have to submit tickets to their company for things. SharePoint 2019 was working fine with users connecting to on-prem AD, but following the remediation, multiple things broke; they disabled NTLM which was one of the authentication providers for SharePoint (We flipped it to Kerberos), and since Office365 was switched over to Azure AD accounts but windows login was not, when a user browses to SharePoint in the web browser they were identified by Kerberos, but when they clicked a document and they tried to open it with office, they received an access denied message.
SharePoint was considered "Out of scope" for their breach remediation contract, so I began trying to work to get it going. I followed this, and was able to create an Azure AD trust provider and switch over to it: https://learn.microsoft.com/en-us/azure/active-directory/saas-apps/sharepoint-on-premises-tutorial
Additionally, I had to convert all of our users and groups to new identifiers. This was some version of the following via script in the sharepoint shell (azureadtrustprod is the enterprise application identifier we created):
i:0#.wDOMAIN\username -> i:0e.tazureadtrustprod[email protected] c:0+.wDOMAIN\groupname -> c:0-.tazureadtrustprodAzureAD_OID
This worked. Users can, for the most part, load the web pages, and open documents directly into office. It's sloppy and clearly far from best practice, but the user experience is that it is working.
Now that we're living with it, things are clearly far from perfect, and I'm not sure where to start to fix it. For starters, lets say I need to share a site with a new user, and I want to give them edit rights, the user search doesn't auto-populate at all. In fact, I've had a ton of trouble correctly identifying users at all; if I go to "Central Admin -> Application Management -> Manage Service Applications -> User Profile Service Application -> Manage User Profiles" I can see the new objects with the correct identifier in the account name, but if I search one of those names it's a total crapshoot. Sometimes they line up with correct groups and users, sometimes they don't. When I go to a site, and see my name in the upper right, sometimes it's my email, sometimes it's my account name (with the whole i:0e.tazureadprod prefix), sometimes it's my display name.
There is no synchronization connection at all in the user profile service application. I think I need to set up a sync to Azure AD, but I'm a bit concerned about adding that and either duplicating users, or somehow messing up existing users, etc.
One thing I noticed; if I go to "Application Management -> Site Collection Administrators" and try to browse to add users to a security principle, the search pulls the 2 correct users from the on-prem AD (via "Organizations") but it allows an invalid free-text name in the AzureADProd auth provider, which is an issue, because Admins granting permissions can type a name, get a success, but it's not a real name and it creates a permission record that does nothing:
https://imgur.com/a/R4mfWUL
Last thing; there is a limited access vault, and I can't assign individual permissions to folders within that vault. I think that's how vaults are supposed to work? However, before all this, users said they had limited access to individual folders in there. It seems I don't need a limited access vault at all, but standard permissions would work; that being said, I am not an owner for the site and no account I try is owner, so it appears I cannot disable limited access?
Clearly a lot is going on, but right now the user experience is stable, so despite it looking completely broken from my side, status is all green and I do not want to break the user experience. Any advice is appreciated.

Quad-ASEAN Defence Exchanges On The Rise
The Malabar Quad exercise will take place in September of this year. For the second consecutive year all four Quad countries will participate.
An Indian task force of 4 ships from the Eastern Naval Fleet are already on a two-month voyage through the South China Sea (SCS) and Western Pacific where the Malabar will take place. The group comprises guided-missile destroyer Ranvijay, guided-missile frigate Shivalik, anti-submarine corvette Kadmatt and guided-missile corvette Korea.
Besides Malabar, they will carry out bilateral exercises with the navies of Vietnam, the Philippines, Singapore (SIMBEX), Indonesia (Samudra Shakti) and Australia (AUS-INDEX). They visited Brunei before proceeding to Guam for the Malabar21.
All the Quad countries have recently (2-6 August) participated in the EAS, ASEAN+1 Ministerial meetings as well as the meeting of the ASEAN Regional Forum (ARF), the main forum for regional security architecture.
The Quad recognise that in the Indo-Pacific, particularly in the SCS, it cannot afford to be facing a hostile China and neutral ASEAN member states. Their buffer has to be more responsive than hitherto. The revitalization of US policy towards the ASEAN could be seen in this context.
The SCS and the Indo-Pacific is seeing an increasing level of activity from the Quad. They are engaging the ASEAN member states more. This has to take into account that China is certain of its control over the SCS and is focusing on Taiwan. China regularly breaches Taiwan’s ADIZ and has deployed both its aircraft carriers with full battle groups around Taiwan. The Chinese are using their occupied island territories in SCS with increased capacity of missiles and now aircrafts. At present, China has the capacity to deploy as many aircrafts as on an aircraft carrier on these Island bases at one time.
Therefore, the US and its partners realise that a single carrier battle group (CBG) would be inadequate to deal with the Chinese strength based off these Islands. At least two CBGs would be required in the Indo-Pacific. The USS Reagan led CBG, from Yokosuka, was deployed to help in the evacuation from Afghanistan and could return soon. It supported the 5th Fleet’s USS Dwight D Eisenhower and its CBG , which have been in the area since April 2021. The CBG led by USS Theodore Roosevelt has also returned to the SCS. If the Indo-Pacific Command is to be more effective it needs to constantly deploy 2 CBGs. The visit of the UK CBG may be partly seen in this context.
Another notable point is that the US scrambled out of Afghanistan and may reduce its involvement in West Asia. The exit from Afghanistan could allow more leeway for releasing periodic CBG deployment under CENTCOM to the SCS and Indo-Pacific.
The US is aware that ASEAN as a whole has been slow in re-engaging them for a joint exercise. The first ASEAN-US maritime exercise was held at the Sattahip naval base in Thailand in September 2019. It passed through Singapore and concluded in Brunei. About 1000 people representing all 10 ASEAN member states and the US promoted a shared commitment to maritime security and stability in Southeast Asia. This included all ASEAN countries including Chinese allies like Cambodia and Laos. Though this was the result of a proposal at the ADMM-US meeting in 2017 and 2018, it has not recurred because of sensitivities towards China and lack of unanimity among ASEAN members. A China-ASEAN exercise of 2018 has also not recurred.
The three ASEAN countries which US Defense Secretary Austin visited recently, undoubtedly have strategic importance. Singapore, for example, is a key port for the US 7th Fleet, playing a significant role in providing logistic support for military aircraft and ships. Vietnam and the Philippines directly confront China over their respective territorial issues in the South China Sea.
Through such efforts, the US has enhanced its engagement with individual ASEAN countries. In April 2021, the Philippines and the US conducted the 36th Balikatan exercise held since 1991. It now has an Indo-Pacific dimension. It was held despite the pandemic with reduced participation, tabletop exchanges, training, real time security training, and similar activities.
A significant result of Secretary Austin’s visit to Philippines was the decision to hold off on the abrogation of the Visiting Forces Agreement, the basis of the US Philippines arrangement for military bases
The US-Indonesia Garuda Shield exercise is another annual exercise for more than a decade. Held in August, it covered the large outlying islands of Indonesia, including Kalimantan, Sulawesi and Sumatra. Over a fortnight it involved amphibious, special forces and airborne units. In June 2021, Indonesian and US Marines conducted joint exercises focusing on conflicts in urban locations and are scheduled to do another exercise in the US later this year. US and Indonesia are constructing a joint maritime Training Centre in Batam, a small city on an island near the Malacca straits and close to Singapore. The US tries to solidify the US-Indonesia Major Défense Partnership and cooperation in support of a free and open Indo-Pacific (FOIP) region.
Thailand manifests the American dilemma in dealing with ASEAN. For several decades, Thailand and the US had a mutuality of interests as Thailand saw the US as a support against Chinese and Vietnamese influence in the region. Thailand, now having abandoned its democratic credentials, its military regime is more inclined towards engaging China and sees it as an uncritical partner. Due to their domestic issues and accommodation with China, Thailand does not have a strategic interest with the US; its main challenge is democracy, not China. The US has reduced financing for Thailand’s arms purchases following the coup in 2014.
This dilemma over democratic rights, economic assistance and proximity makes the US rethink its ASEAN engagement. Thus, traditional allies like Thailand and Philippines become ambivalent whereas old enemy Vietnam is a strategic partner.
During July 2021, Australia and Japan with eight other countries held joint exercises around Australia. This was preceded by the Australia-US, Talisman Sabre exercise. It was later joined by Japan, UK, Canada, South Korea and New Zealand. India, Indonesia, Germany and France sent observers. This combined exercise would further strengthen the FOIP.
The traditional ASEAN policy of outsourcing its security requirements mainly to the US was challenged when China became more aggressive and the US pivot to Asia did not happen under the Obama administration. During the Trump period, ASEAN was not a priority for the US. Under the Biden administration, the Indo Pacific and the Quad have a much higher priority.
Thus, the three-pronged policy recognises that China is the main factor and ASEAN has accommodated it, particularly in the economic sphere. The US wants to reengage with ASEAN and select member states. For this it prefers the regional architecture, to provide space, and a buffer between China and its rivals.
Increasingly the ASEAN buffer was inclining towards China. Now, efforts are made to restore the balance within that space particularly on the security and functional side. Undoubtedly for this to happen ASEAN member states also have to play a role.
ASEAN unanimity is now passe. When Cambodia takes over the chair for 2022 it is likely to play its pro-China role that it did in 2012. Hence, engaging ASEAN, praising its centrality and not giving up on it, is part of the policy.
A third prong of the policy of the US and other Quad members is clearly to engage with willing ASEAN member states who have greater strategic value. In this, Singapore, Indonesia, Vietnam, and Philippines are the main partners. Thailand, Malaysia, as well as Myanmar, due to their internal situations are not forthcoming. Such ‘ASEAN Plus’ policies from individual member states are small steps.
In my view this effort to deal with specific member states have increased their security and functional support for instance in fighting the pandemic. This could be viewed more vigorously by the US and its Quad partners. With this objective in mind, the significance of defence engagement of the US, the EU countries and the UK, with ASEAN countries certainly have greater significance as well.

2023.06.02 19:12 Alyafei-Ameera Payment gateway vs Payment processor vs Merchant account

Payment gateway vs Payment processor vs Merchant account
The payments industry is a fast-paced market that is constantly changing due to the introduction of new payment systems and new technologies.
We're seeing payment technology companies play a bigger role in the payments industry, particularly as technology advances—and many of them are even integrating with traditional financial institutions to appeal to the new consumer and merchant preferences. Unlike in the past, when payment processing was simply about facilitating the flow of money, the latest payment processing players are completely redefining the customer experience and enabling business owners to operate their businesses with remarkable ease.
On the surface, the payment processing industry appears to be easy, but there are many parties involved in what appears to be a simple procedure. When a customer swipes their credit or debit card at a payment terminal, the transaction usually takes just a few seconds—but the procedure itself requires several steps and several players that communicate with one another. So, first and foremost, we must understand how it functions.
Let us begin with the individuals involved.
  1. The cardholder is the person who possesses the credit card used to make a purchase.
  2. The business that offers products or services to cardholders is known as the retailer.
  3. The acquirer is the merchant bank that manages credit card transactions on the merchant's behalf, accompanied by the credit card brand or networks, such as Visa and MasterCard.
  4. Finally, the financial institution that issued the credit/debit card is known as the issuing bank.
Now, using this example, let's see how these participants conduct a credit/debit card transaction.
Fatima, a cardholder, buys an apple from Mohammed, a brick-and-mortar dealer, for 1.00 QR. Fatima inserts her credit card into a chip reader and dials out to obtain an authorization code at the POS (point-of-sale) terminal. What happens next is as follows.
The Authorization Process
Ø The information collected on the POS terminal is first sent to the acquirer by the payment processor.
Ø The acquirer sends the information to the issuing bank through the credit card network, says Visa, and requests payment authorization for a one QR transaction from the issuing bank.
Ø The issuing bank checks to see if Fatima has enough money if the expiry date is correct, and several other items, such as matching Mohammed's business address and the cardholder's billing address.
Ø When the issuing bank confirms that all is right, it issues an approved authorization code and returns it in the same manner that it received an authorization request from Visa and the acquirer.
Ø On his POS terminal, Mohammed sees the accepted message.
Ø The issuing bank places a one QR hold on Fatima's credit card account in order for Mohammed to collect the proceeds from the transaction.
The Settlement Process
Ø At the end of the day, all these authorizations are stored in a batch in the POS terminal.
Ø When Mohammed close the batch, the payment processor sent it back to the respective issuing bank for final clearance, using the same channels as before.
Ø They are sent to the acquirer first, and then to the issuers via credit card networks.
Ø Following the acquirer's funding of the merchant's bank account, each issuing bank eliminates the hold and withdraws actual funds from the cardholder's account.
Now you understand the whole payment cycle. So it's time to dive in and grasp the most puzzling words that merchants encounter while searching for online payment services: a merchant account, a payment processor, or a payment gateway.
What is a Merchant Account?
In layman's terms, a merchant account is similar to a holding account where all payments are routed before being deposited into a traditional bank account. This account is dedicated to accepting payments from online merchants. So all the online payments received for your sales are stored in this account. A merchant account is the same whether you sell physical things, subscriptions, or digital products.
After successfully applying for a merchant account, each merchant is granted a unique Merchant ID. A merchant ID is a one-of-a-kind code provided to merchants by a payment processor. This code, which is frequently abbreviated as MID, is provided to parties involved in transaction reconciliation along with cardholder information. When communicating with their processor and other parties, a merchant can use the MID to help them identify themselves.
Your merchant account might be classified as either high risk or low risk based on criteria defined by merchant service providers.
The following are the most common criteria, considered to classify high-risk and low-risk merchant account:
ü Average monthly sales volume
ü Average credit card transaction
ü Different currency accepted
ü Offer recurring or subscription package
ü History of excessive chargeback
ü Main product offering
ü Sell to a high-risk country
These criteria differ considerably depending on the payment processor's guidelines.
Many times, small business owners have never heard the phrase "high-risk merchant account" unless their company is recognized as such. At first, it appears to be a bit mysterious. In some situations, it may appear to be an unjust judgment against your company, the service you give, the items you offer, or you personally. However, this should not be cause for concern. You would be able to obtain better payment options if you have a thorough understanding of this term.
At first falling into the high-risk merchant account category seem like a disaster, but it isn't. It really has a lot of advantages.
  1. Economic expansion is a possibility: In contrast to conventional merchant accounts, which are limited to transactions only within the parent country, high-risk merchant accounts have no restrictions and can transact money in any currency, giving them a real possibility of globalizing their market.
  2. There are no volume controls: High-risk merchants do not have to worry about a monthly volume target, which means they can transact as much as they want.
  3. Account termination is less likely: If a typical merchant receives a large number of chargebacks (more than 1%), their account will be terminated; this is not the case for high-risk merchant accounts because the providers are aware that it is possible, so they are secure, and their account will not be terminated due to high chargebacks.
Understanding these phrases and determining which group your firm belongs to is preferable.
What is a Payment Processor?
A payment processor is a financial organization that provides payment processing services to online retailers. For merchant acquiring banks, they manage transactions from different sources such as credit cards and debit cards. It may form alliances with other businesses that interact with merchants or consumers. They are usually divided into two types: front-end and back-end.
o Front-end processors have links to different card organizations and provide merchant banks with authorization and settlement services.
o Back-end processors approve settlements from front-end processors and, for example, transfer funds from the issuing bank to the merchant bank through the Central Bank.
To offer their services directly to an online merchant, a payment processor gets into a reseller relationship with a payment gateway or a merchant account provider.
Payment processor example: PayPal is the first online payment processing company, founded in 1998.
What is a Payment Gateway?
A payment gateway allows you to be paid online when your clients make an online purchase. You can accept card payments directly from your website with the authorization granted by a payment gateway. As a result, it serves as a link between the transactions on your website and the payment processor. Transaction data cannot be disclosed due to security issues.
Before submitting the authorization request to the processor, several payment gateways offer tools for automatically screening orders for fraud and calculating tax in real-time. The tools for detecting fraud include geolocation, velocity pattern analysis, 'blacklist' lookups, delivery address authentication, identity morphing detection, and basic AVS tests.
There are many other factors to be considered when selecting a payment gateway. Check out here for more detailed information about payment gateway https://sadad.qa/en/best-payment-gateway-qata
Payment gateway vs Payment processor vs Merchant account
The most crucial parts of online commerce are payment processors, payment gateways, and merchant accounts. Any company that accepts online payments must understand the key differences and similarities between these three.

https://preview.redd.it/5p2lsnkn0n3b1.png?width=729&format=png&auto=webp&s=4dc12a9e2f1d96f057a97cc8cbcfad7475fd797b
Account approval:
Certain compliance and formalities must be followed if a retailer wishes to open some sort of account.
In order to obtain a merchant account, you must have extensive paperwork showing that what you offer is legal and does not violate any foreign laws or internal bank regulations.
Following the initial compliance audit, an additional bank compliance verification, such as:
· Do your company and website meet the compliance criteria of major card providers such as Visa, MasterCard, or American Express?
· Your chargeback History – have you kept a fair number of chargebacks?
This phase could take up to a week or month in total.
As you can see, obtaining a separate merchant account is a difficult task, but it is well worth the effort.
There is even less documentation to fill out in order to receive processor approval, and you will have access to your account in a matter of hours. As a result, this is one of the fastest strategies in terms of approval time. But it comes at a price.
For payment gateway, you need not wait for your account to be accepted, you will have immediate access to it.
Implementation:
For merchant account setup, you will be given either a snippet of code to implement on your website or full API and testing sandbox access. Custom integration with your website or app will be needed. You may need to perform custom integration with your website or app. Payment processors have regular solutions. There is no space for customization. Payment gateway implementation varies depending on the service provider and the technologies used to create the API or website.
Account stability
Account stability refers to the assurance that your account will not be shut down or placed on hold unexpectedly.
For an individual merchant account, you have complete control over the stability and efficiency of your account. In the event of a problem, your account manager will contact you. In the case of a payment processor, Merchants are not reviewed for Visa/MasterCard compliance and, instead of assisting them in complying with the regulations, the chances of account termination are increased without much clarification. While using a payment gateway, account stability varies depending on whether you're connecting with a payment processor or a merchant account.
Pricing
Expect a flat-rate pricing model when working with a payment processor. In contrast, depending on the merchant's business model and transaction volume, pricing in a merchant account is typically versatile and completely negotiable. If you use a third-party payment gateway solution, you can incur costs for integration and usage.
Risk Management
You can build your own anti-fraud rules and exceptions with a merchant account and a payment gateway to allow legitimate customers in. In a payment processor, this type of freedom is not available. As a result, the rate of payment acceptance is poor.
Terms & conditions
Terms and conditions for merchant accounts can be negotiated depending on the business model and processing volume. However, this is not the case for payment processors.
Support
There are several crucial circumstances that could have an effect on your online payment infrastructure. When selecting either of these, you should keep support in mind as a critical factor. You will be assigned a dedicated merchant account manager when you open a dedicated merchant account. In the case of a payment processor, you must meet standard protocol to get the problem resolved. Support for payment gateways varies depending on whether you're integrating with a payment processor or a merchant account.
You don't have to be concerned with payment gateways, payment processors, or merchant accounts. SEC Alert! Statement Second Commission Statement Relating to Certain Administrative Adjudications. An update on how certain databases were not configured to restrict access by staff from our Division of Enforcement to memoranda drafted by staff from the Adjudication Group.
Source: https://www.sec.gov/news/statement/second-commission-statement-relating-certain-administrative-adjudications
On April 5, 2022, the Commission issued a Statement Relating to Certain Administrative Adjudications (the “April 5 Statement”) describing a control deficiency related to the separation of enforcement and adjudicatory functions within the agency’s system for administrative adjudication. As the April 5 Statement explained, for a period of time, certain databases maintained by our Office of the Secretary (“OS”) were not configured to restrict access by staff from our Division of Enforcement (“Enforcement”) to memoranda drafted by staff from the Adjudication Group (“Adjudication”) in our Office of the General Counsel (“OGC”). As a result, in a number of adjudicatory matters, administrative support staff from Enforcement responsible for maintaining Enforcement’s case files accessed Adjudication memoranda via OS’s databases. In many instances, those administrative staff also emailed Adjudication memoranda to other administrative staff for potential upload to Enforcement databases; once uploaded, the memoranda became accessible more broadly to Enforcement staff.
When it was discovered that Enforcement staff had access to Adjudication memoranda, the Commissioners were notified, as was the Commission’s Office of Inspector General. As the April 5 Statement explained, the Chair immediately directed the implementation of remedial measures, including enhanced access controls, to ensure that Enforcement staff would no longer be able to access these memoranda in the OS databases or through the Enforcement databases to which they may have been uploaded. The Chair also initiated a comprehensive internal review to assess the scope and potential impact of the control deficiency. This review has been conducted by experienced investigative staff from the Division of Examinations under the supervision of the Commission’s General Counsel (the “review team”). As noted in the April 5 Statement, the review team has been supported by Berkeley Research Group, LLC, a consulting firm retained by OGC that includes a team of experienced investigators and forensic analysts.
The April 5 Statement disclosed the review team’s findings regarding two matters arising from administrative adjudicatory proceedings as to which challenges were pending in the federal courts. In the April 5 Statement, the Commission also committed to releasing information about additional affected matters. We are now releasing the below statement from the review team, which provides additional information about the two matters discussed in the April 5 Statement, as well as findings regarding additional adjudicatory matters that are currently pending before us. Those matters include 28 matters as to which one or more Adjudication memoranda specific to a particular matter were accessed by Enforcement administrative staff, as well as 61 additional matters in which one or more Adjudication memoranda broadly applicable to numerous pending matters were accessed by Enforcement administrative staff.
We deeply regret that the agency’s internal systems lacked sufficient safeguards surrounding access to Adjudication memoranda, and we are continuing our work to ensure that, going forward, work product from the Adjudication staff is appropriately safeguarded. We take this lapse in controls very seriously and are committed to both informing the public about the scope of this issue and preventing any similar lapses in the future.
The information presented below is based on the work of the review team. We will release additional findings from the review team as appropriate.

Review Team Findings

Summary of Review and Findings

The review team has interviewed more than 250 current and former staff members, including individuals from Enforcement, OS, and OGC. The review team has collected and considered documents from Enforcement, OS, and OGC, including over 500,000 pages of emails and attachments. The team has also reviewed hundreds of case files in Enforcement’s case management database (the “Enforcement Centralized Database”), including the electronic case files of each of the matters discussed below. Working with Berkeley Research Group, the review team has analyzed over 25 million rows of data from access logs for various systems.
Part A and Exhibit 1 provide additional information regarding Cochran and Jarkesy, the two matters addressed in the Commission’s April 5 Statement.
In addition to those two matters, the review team identified additional matters that are currently pending before the Commission in which Enforcement administrative staff accessed one or more Adjudication memoranda that either: (1) pertained specifically to that matter (or in some instances to another matter but were maintained in the same Enforcement case file); or (2) were not specific to any individual adjudicatory matter but rather described procedural actions that Adjudication staff recommended that the Commission take in many (or all) pending adjudicatory proceedings. For ease of reference, the first set of memoranda is referred to as “case-specific memoranda,” and the matters they address are referred to as the “Affected Matters.” As discussed below, the review team identified 28 Affected Matters. The second set of memoranda—those addressing more generally applicable procedural actions—is referred to as “Omnibus Memoranda.” The review team determined that Enforcement administrative staff accessed eight Omnibus Memoranda and that there are 61 additional currently pending matters encompassed by one or more of those memoranda.
Part B and Exhibit 2 provide the review team’s findings about the 28 Affected Matters, identifying the case-specific memoranda accessed by Enforcement staff that relate to each of those matters. Part B also notes the instances in which an Omnibus Memorandum was uploaded to one of the Enforcement case files for the Affected Matters.
Part C and Exhibit 3 provide additional information about the eight Omnibus Memoranda that were accessed, including the scope of the adjudicatory matters encompassed by each. Exhibit 4 identifies—as to Cochran, Jarkesy, and all of the Affected Matters—the Omnibus Memoranda that encompass each matter. Exhibit 5, in turn, identifies the 61 additional pending adjudicatory matters in which only an Omnibus Memorandum encompassing that matter was accessed by Enforcement staff—that is, those currently pending matters encompassed by an Omnibus Memorandum as to which the review team found no evidence that a case-specific Adjudication memorandum was also accessed by Enforcement staff.
In all instances, the review team found that the Enforcement administrative staff accessed the Adjudication memoranda as part of an effort to track and upload to the Enforcement Centralized Database all Enforcement memoranda recommending Commission action in enforcement proceedings. Consistent with this effort, the overwhelming majority of the memoranda accessed by the Enforcement administrative staff were memoranda to the Commission submitted by Enforcement staff. But because the OS databases were not configured to prevent Enforcement staff from accessing Adjudication memoranda—and the Enforcement administrative staff did not distinguish between Enforcement and Adjudication memoranda—those administrative staff included some Adjudication memoranda in their effort to continually upload relevant materials into the Enforcement Centralized Database.
As indicated in Part B and Exhibit 2, in each of the 28 Affected Matters, an Enforcement administrative staff member accessed one or more case-specific Adjudication memoranda and emailed many of those memoranda to other Enforcement administrative staff. The administrative staff member who initially accessed the memoranda generally did not distribute the documents to other administrative staff members until after the Commission had voted on the action recommended by the memoranda. The administrative staff members who received these memoranda via email then typically uploaded the memoranda into the Enforcement Centralized Database. As a result, some case-specific Adjudication memoranda became accessible in the Enforcement Centralized Database to all Enforcement staff, including individuals investigating and prosecuting the matters referenced in those memoranda. None of the administrative staff members had a practice of contacting Enforcement staff directly responsible for investigating and prosecuting the relevant matters. And the review team found no evidence that any Enforcement staff assigned to investigate and prosecute any of the Affected Matters accessed any case-specific Adjudication memoranda before the Commission approved the action recommended in those memoranda.
As indicated in Part C and Exhibit 3, one of the eight Omnibus Memoranda accessed by Enforcement administrative staff was uploaded to the Enforcement Centralized Database in the Enforcement case files for Cochran and four of the Affected Matters and thus became accessible to all Enforcement staff. The remaining Omnibus Memoranda were accessed by Enforcement administrative staff via the OS databases but were not uploaded to the Enforcement Centralized Database, emailed to, or otherwise accessed by, any other Enforcement staff.

Access to Adjudication Memoranda by Enforcement Staff in the New York Regional Office

Enforcement administrative staff in the Commission’s New York Regional Office (“NYRO”) maintained a practice of uploading Enforcement memoranda relating to matters handled by NYRO staff to a separate database created and maintained by NYRO Enforcement staff (the “NYRO database”). The NYRO database was intended to serve as a supplemental reference resource for Enforcement memoranda and ultimately contained over 250 Enforcement memoranda. When the NYRO Enforcement administrative staff received Adjudication memoranda via the process described above, they too did not distinguish between memoranda drafted by Enforcement staff and those drafted by Adjudication staff.
Between February 2019 and August 2020, NYRO administrative staff emailed several Adjudication memoranda to an Enforcement supervisor in NYRO (“Enforcement Supervisor”), an attorney responsible for overseeing the work of other Enforcement attorneys in NYRO. The administrative staff’s emails sought instruction whether the Adjudication memoranda should be uploaded to the NYRO database. This occurred with respect to Jarkesy, as well as three of the Affected Matters; where it occurred with respect to those matters, it is noted below and in Exhibit 1 or 2, as appropriate. In two such instances, the NYRO Enforcement staff uploaded the memoranda to the NYRO database at the direction of the Enforcement Supervisor.
The review team found no evidence that either NYRO administrative staff or the Enforcement Supervisor circulated any Adjudication memoranda to anyone else, including anyone directly involved in investigating and prosecuting the relevant matters. The review team also determined that, for each of the Adjudication memoranda sent to the Enforcement Supervisor, transmission occurred after the Commission had already approved the action recommended in the Adjudication memorandum. For the Adjudication memoranda uploaded to the NYRO database, the review team determined that no one other than administrative staff accessed those memoranda in the NYRO database.

Outstanding Seriatim Reports

From at least 2015 through 2021, OS generally sent a weekly report to senior staff in Enforcement (including, at times, the Director, Deputy Director, and Chief Counsel) that provided the status of certain outstanding recommendations from Enforcement to the Commission. Referred to as the “Outstanding Seriatim Report,” this report listed all outstanding recommendations from Enforcement as to which the Commissioners intended to vote sequentially (in seriatim) without convening a meeting. The report briefly described the Enforcement staff’s recommendation and the status of the Commissioners’ votes on each recommendation. OS staff members generated the reports from one of the OS databases that did not adequately segregate Adjudication memoranda. While OS staff typically excluded information about Adjudication matters from the Outstanding Seriatim Reports, in some instances, limited information briefly describing Adjudication staff’s recommendations was inadvertently included in the reports.
Thirteen weekly Outstanding Seriatim Reports—one sent in February 2016 and twelve sent between June 2019 and July 2020—included Adjudication-specific information regarding one of the matters discussed below. Where this occurred, it is noted below and in Exhibit 1 or 2, as appropriate. The review team found that none of these Outstanding Seriatim Reports attached an Adjudication memorandum, nor did the review team find any evidence that the Outstanding Seriatim Reports were forwarded to any staff assigned to investigate and prosecute any of the matters.

A. Cochran and Jarkesy

As explained in the April 5 Statement, in both Cochran and Jarkesy, Enforcement administrative staff accessed one or more Adjudication memoranda and emailed those documents to other administrative staff who, in a number of instances, uploaded the memoranda to the Enforcement Centralized Database. As a result, certain Adjudication memoranda were accessible to all Enforcement staff, including attorneys investigating and prosecuting Cochran and Jarkesy.
  1. David S. Hall, P.C. d/b/a The Hall Group CPAs, David S. Hall, CPA, Michelle L. Helterbran Cochran, CPA, and Susan A. Cisneros, Admin. Proc. 3-17228
The Commission issued an Order Instituting Proceedings (“OIP”) in this matter on April 26, 2016.[8] In March 2017, an administrative law judge (“ALJ”) issued an initial decision finding that respondents, auditors Michelle Helterbran Cochran and Susan Cisneros, had engaged in improper professional conduct in connection with their audits of publicly traded companies.[9] In June 2017, the Commission issued an order providing that the ALJ’s decision had become the final decision of the Commission.[10] Cochran sought Commission review of that decision, but while that review was pending, the matter was remanded and assigned to a new ALJ in light of the Supreme Court’s decision in Lucia v. SEC.[11] While the proceeding was pending before the new ALJ, Cochran filed a lawsuit in federal district court, seeking to enjoin the administrative proceeding.[12] The district court dismissed her complaint for lack of jurisdiction, and a panel of the U.S. Court of Appeals for the Fifth Circuit affirmed.[13] In December 2021, the en banc Fifth Circuit reversed the district court’s decision and remanded the case to the district court.[14] The Supreme Court subsequently granted the government’s petition for certiorari and, on April 14, 2023, affirmed the en banc court’s decision, holding that the district court has jurisdiction to hear Cochran’s complaint.[15] All deadlines in the administrative proceeding are postponed pending resolution of the litigation in federal court.[16]
As described in the Commission’s April 5 Statement (and further detailed in Exhibit 3), administrative staff in Enforcement accessed—and uploaded to the Cochran case file in the Enforcement Centralized Database—one Omnibus Memorandum, dated November 29, 2017, encompassing the Cochran matter. Enforcement administrative staff initially accessed the memorandum the day after the Commission issued its order on the issues presented in the Adjudication memorandum (hereinafter referred to as a “corresponding order”). The staff emailed the memorandum to other Enforcement administrative staff, who uploaded the document to the Cochran case file (as well as to several other case files, as indicated in Exhibit 3).
As described in the Commission’s April 5 Statement—and in submissions to the U.S. District Court for the Northern District of Texas[17] and the U.S. Supreme Court[18] by the Department of Justice (“DOJ”)—the review team found no evidence that Enforcement staff accessed any case-specific Adjudication memoranda relating to the Cochran matter, that any of the individuals assigned to investigate and prosecute the Cochran matter ever accessed or took any action influenced by the November 29, 2017 (or any other) Omnibus Memorandum, or that any of these individuals contacted or communicated with the Adjudication staff advising the Commission in its decision-making in this matter.[19]
2. John Thomas Capital Mgmt. Grp. LLC d/b/a Patriot28 LLC, and George R. Jarkesy Jr., Admin. Proc. 3-15255
The Commission issued an OIP in this matter on March 22, 2013.[20] In October 2014, an ALJ issued an initial decision finding that respondents George R. Jarkesy Jr. and John Thomas Capital Management Group LLC, d/b/a Patriot28 LLC (“JTMG”), had violated the antifraud provisions of the federal securities laws.[21] Respondents appealed that decision to the Commission, and Enforcement cross-appealed the ALJ’s determination on sanctions. While the appeal was pending, the proceeding was remanded and reassigned to a different ALJ in light of Lucia, though respondents moved to vacate the remand order and proceed with their previously filed appeal on the existing record.[22] The Commission granted that request and, in September 2020, issued an opinion finding that respondents had violated the antifraud provisions and an order imposing a penalty, disgorgement on JTMG, and an industry and penny stock bar on Jarkesy.[23] Jarkesy filed a petition for review with the Fifth Circuit, which, in May 2022 vacated the Commission’s decision.[24] The Fifth Circuit denied the government’s petition for rehearing en banc. On March 8, 2023, the government filed a petition for a writ of certiorari, seeking the Supreme Court’s review of the Fifth Circuit’s decision.[25]
As described in the Commission’s April 5 Statement—and as DOJ notified the Fifth Circuit[26]—and as further detailed in Exhibit 1, an administrative staff member in Enforcement accessed nine case-specific Adjudication memoranda relating to the Jarkesy matter and emailed them to other administrative staff in Enforcement, who uploaded seven of them to the Jarkesy case file in the Enforcement Centralized Database. The review team found that administrative staff also emailed one of these Jarkesy-specific memoranda to the NYRO Enforcement Supervisor but that the memorandum was never uploaded to the NYRO database. In addition, in one instance, an Outstanding Seriatim Report circulated to senior Enforcement staff included a reference to one of the case-specific Adjudication memoranda relating to the Jarkesy matter.
The review team found no evidence that any of the individuals assigned to investigate and prosecute the Jarkesy matter ever accessed these Adjudication memoranda. The review team found no evidence that either the NYRO Enforcement Supervisor or any of the individuals assigned to investigate and prosecute the Jarkesy matter ever took any action influenced by these memoranda.[27] The review team also found no evidence that any of these individuals contacted or communicated with the Adjudication staff advising the Commission in its decision-making in this matter.[28]

B. Affected Matters

As noted above, there are 28 Affected Matters. In 20 of those matters, Enforcement administrative staff uploaded one or more case-specific Adjudication memoranda to a case file in the Enforcement Centralized Database.
As to all of the Affected Matters, the review team found no evidence—including through interviews with Enforcement staff—that access to Adjudication memoranda impacted any Enforcement filings or decision-making in those matters. In 23 of the Affected Matters, Enforcement made no filings between the date an Adjudication memorandum was initially accessed by a member of Enforcement’s administrative staff and the date the Commission voted to take action on the recommendation presented in the memorandum. In all of the remaining five Affected Matters—those in which an Enforcement filing was made during the time period between initial access and Commission approval—the Enforcement filing was unrelated to the subject matter of the recommendation in the Adjudication memorandum.[29]

C. Omnibus Memoranda

As noted above, and described in greater detail in Exhibit 3, Enforcement administrative staff accessed a total of eight Omnibus Memoranda recommending that the Commission take certain procedural actions in then-pending administrative adjudicatory proceedings.[135] Six of the memoranda involved recommendations following legal developments in litigation challenging the constitutionality of the Commission’s ALJs.[136] The remaining two involved recommendations by Adjudication staff related to the 2018-2019 federal government shutdown.
As indicated in Exhibit 3, one of the eight Omnibus Memoranda—the November 29, 2017 memorandum—was uploaded to the Enforcement Centralized Database. It was not uploaded to the NYRO database. The remaining seven were never emailed to, or otherwise accessed by, other Enforcement administrative staff; nor were they uploaded to either the Enforcement Centralized Database or the NYRO database. The review team found no evidence that the administrative staff member who accessed the Omnibus Memoranda contacted any Enforcement staff responsible for investigating and prosecuting the relevant matters about any of these memoranda.
Exhibit 4 identifies the particular Omnibus Memoranda that encompassed each matter described in Parts A and B (and listed in Exhibits 1 and 2). Exhibit 5 lists the additional currently pending adjudicatory matters in which the review team found that only an Omnibus Memorandum encompassing that matter was accessed (i.e., the review team found no evidence that a case-specific Adjudication memorandum was accessed relating to those matters). For each such matter, Exhibit 5 also indicates the particular Omnibus Memoranda that encompassed that matter.

EFFECTIVE JUNE 4TH: new CTA schedule for listed buses
I know it is a hot topic on this sub to talk (more complain) about how awful the post-pandemic CTA buses and trains have been. I am happy they are listening and making changes. I really hope this will improve the CTA.

2023.06.02 18:46 ExpensiveEffective53 A bit of advice on air conditioning?

Hi there,
New to Toronto, so still getting used to the renting standards here. My unit has air conditioning (as outlined in the lease agreement). It’s controlled by a central thermostat that my landlord (lives upstairs) controls. Though, there’s some issue with the circulation.
She has turned on the AC, but the thermometer in my unit is at 79°F. So I just wrote an email to her letting her know about this, she said she would drop the temperature down. Still didn’t change my temperature, but she told me she has it set to 66°F.
So I asked this, verbatim: Thanks [landlord] I appreciate it, however I don't want you to be uncomfortable either. Mine is still at 79 degrees. It seems like it may be an issue with ventilation or the thermostat? Is it possible to call an HVAC provider to evaluate before the summer heat?
She responded with this: Unfortunately, I cannot do that. We'll have to work with the AC system that we have and understand that it won't be the AC you have at the mall. It is not a requirement for a landlord to provide AC.
So… not sure what to do. It’s in the lease agreement, but does that also entail it should reasonably work? Sorry if this is a dumb question, I just wanted a second opinion.
Thanks.

2023.06.02 18:09 InitiateConscious Feedback on my recovery/spiritual story

I appreciate everyone in this sub Reddit. I haven’t posted anything here yet but I have read a lot. I have been working on a book for the last several months and I have 28,200 words. I would like to share one of my chapters to get feedback.
This is chapter 8
My father was a chief of police and several other members of my family were in law enforcement. I had been raised around and amongst police officers since I was very young and the seeds had been planted in my heart to follow in my father’s footsteps. I dropped out of high school in my junior year because I was utterly failing in my academics and frankly had no interest. I was working at Marvin’s IGA grocery store for most of the time when I was 17. After I turned 18 however, I began to look for a more serious job. My dad had heard that the local jail was hiring and that they would hire at 18 years of age. He explained that the jail was typically the first step on the path on starting a career in law enforcement and that many cops he knew had spent a year or two working at the jail before becoming police officers. In February of 2008 I applied and in early March I began a pre-employment screening process. This consisted of a background check and a polygraph test. I had never been criminally in trouble so the background check went fine. I am sure some of them had heard about my UFO 911 call but it was never mentioned to me if they had. As I walked into the administration side of the Sheriff’s Office, I could feel my heart pounding against my chest. I knew what was waiting for me - a dreaded polygraph test. The room was small, and the only thing between me and the stern-looking lieutenant was a desk. But what caught my attention was the intimidating chair in front of the desk, with various sensors and attachments ready to measure my every physical response. The lieutenant welcomed me, but his tone was stern as he explained that this was a mandatory test for all recruits seeking employment at the facility. The silence in the room was deafening, and the air was thick with tension. I knew that this moment would determine my future, and I could not help but wonder, would I pass the test or fail? I had been previously told what sorts of questions would be on the test. Several of which I knew I would have to lie on. Especially if they asked if I had ever used illegal drugs as I had smoked marijuana with friends by this point. I had been quite a book reader at this point in my life all ready and at one point I had read about how to fool a polygraph test and it essentially went like this. To fool the polygraph sensors, you have to believe your own lies. The sensors are looking for physiological signs of deception, guilt, anticipation anything of that sort. So, you must not view your answers as lies. There has to be an agreement in my mind already that the entire thing is a farce. This man is not really trying to read me, this is simply a round about way of filling out a form in his possession and I am putting the answers as I want them to appear on the form. So, in my heart this is no a question of true or false. It is a question of what I want to appear on the paper. Therefor when a question is asked. I am not lying regardless of what I say, I am simply dictating to him what to put on the paper for me. Another tip I had read was to focus on a particular place on the wall in front of you and concentrate on it. I sat down and said I was ready. He then began by asking my name and what town we were in for a base reading. Next came the questions. Have you ever committed a serious crime that went undetected? A normal response to this question would be to begin to think back over one’s history and to question one’s self to make sure you weren’t missing anything. However, I stared at the wall and decided the answer to that question needed to be no, so I said no. The polygraph examination went on like this until the end. I can’t say I passed with flying colors however. Lieutenant Carter at the end looked at me and told me my lines were strange and did not indicate either deception or truthfulness but were what they would call inconclusive. Which is still passable for I passed my exam although I got a few odd looks from the lieutenant before I left. Not long after this I was being fitted for a jailer uniform and being distributed the equipment I would be using in my new role as Jail Deputy. I had a grand sense of embarking on a noble quest that would lead to untold adventures and a feeling of being a part of something much bigger than myself. Putting on the uniform for the first time went straight to my head as I could almost feel the new powers of authority emanating out from my being. The jail was connected to the main Sheriff's Office by a set of sturdy steel doors, which were operated remotely from a centralized command center. Once inside, there was no way out unless the command center authorized it. Although there were one or two physical keys, they were not kept on the premises and were reserved only for emergency situations where the controls at the command center were inaccessible. As I walked down the corridor towards the "Pod" where I was to begin my work, I couldn't help but notice the thick, grey concrete walls that lined the passageway. The Pod I would be working in for the first few months was known as D Pod. Essentially, a Pod was a hexagonal command center situated on a raised platform, encircled by remotely operated doors that led to various cell blocks. D-Pod comprised of 6 cell blocks and 2 recreational yards. When entering D-Pod, the two largest cell blocks, D-109 and D-130, were situated on the left-hand side. D-109 housed individuals jailed on misdemeanor charges, while D-130 was reserved for those facing felony charges who had not yet gone to trial. Essentially, it was the pre-trial felony block. On the right-hand side, there were four smaller blocks. One of these, D-150, hosted federal inmates who were predominantly Hispanic individuals with immigration-related holds. However, occasionally, unique inmates with charges related to federal crimes, such as crossing state borders to commit a crime, would also be held in D-150. The final two blocks were D-169 which hosted all inmates with sex related crimes and D-170 which held all inmates with Felony charges who had recently been convicted at trial but had not been sent to prison yet. Initially, my job at the jail was titled "Working D-Pod Direct," which involved spending time in the two largest cell blocks, D-109 and D-130, rather than simply standing in the command area of the Pod. As I began to acclimate myself to the environment and interact with the inmates, I noticed a variety of odors that were foreign to me. The persistent scent of sweat and human body odor was particularly revolting. I couldn't help but cringe at the thought of it. As I glanced around at the inmates, I couldn't help but feel a sense of disdain towards them. They had made choices that landed them in jail, and now they were paying the price. While I would be civil and courteous, I didn't feel as though I owed them anything. It was clear that breaking the rules on my watch was not an option. I quickly familiarized myself with the list of inmate infractions and their respective punishments. If an inmate broke certain rules, they could be subjected to lockdown. It became somewhat of a game to try and catch them in the act, and why not? They had committed a crime and their time in jail should not be pleasant or enjoyable. After all, what motivation would they have to not reoffend and come back? Thanks to constantly splitting wood, my arms had become rock-solid. In addition, I had been diligently honing my boxing skills and was eager for a potential altercation. The idea of an inmate attempting to intimidate me was thrilling, and I relished the possibility of a challenge. My father had earned a reputation as a formidable fighter, and now it was time for me to begin carving out my own legacy. As I searched through the bunks in D-109, my eyes caught sight of an inmate's thin, uncomfortable mat resting on top of his metal bunk. I couldn't help but wonder what could be hiding underneath it. My curiosity got the best of me, and I lifted the mat to find small, circular objects made of toothpaste. It was clear to me that the inmate had made these "mints" himself. I immediately located the inmate responsible and demanded an explanation for his actions. He fumbled through a feeble excuse, which did nothing to sway my judgement. As punishment, I stripped him of his privileges to have a mat and associate with other inmates. I then escorted him to E-Pod, on the opposite side of the jail, which served as the lockdown block. While I found the concept of lockdown amusing at the time, it was a truly awful experience for the inmates. They were stripped of all their belongings except for a Bible and confined to an empty cell for 23 hours a day, with only one hour of freedom to take a shower or read the newspaper in the main area of the cell block. I found myself getting a rush from catching inmates breaking the rules. It became a daily goal of mine to ensure that at least one person was placed in lockdown. At the time I thought that the rules were very simple for people who clearly cared little about society, simple dos and don’ts. There were big ones such as “Don’t assault any jail staff”, “No Fighting.”, “Attempts to escape.”, “No sexual activity.” Etc. Then there were the pettier issues, these were the ones I spent my time on. “Leaning on the wall.”, “Storing food after meals have been picked up.”, “Being unsanitary, failing to keep cell clean.”, “Possessing anything not authorized or issued directly to the inmate through jail staff.” The latter rule was very open to interpretation, and was used if inmates had extra of anything. Many an inmate met lockdown due to having an extra roll of toilet paper in those days. A typical portion of my day might go like this. I stride purposefully down the dimly-lit prison block, my boots echoing off the concrete walls. My chest swells with a sense of authority as I approach the inmate's cell. Without a word, I barge in, my hand firmly gripping my baton. "Face the wall!" I bark, my voice carrying the weight of my position. The inmate jumps, fear etched on his face as he turns to comply with my order. I begin to inspect his cell, my eyes scanning every inch for any signs of contraband. My nose wrinkles at the faint smell of sweat and mold, but I push on, determined to maintain control. And then, there it is. An extra roll of toilet paper, sitting innocuously on the shelf. I whirl around to face the inmate, my lip curling in disdain. "What is this?" I demand, my tone dripping with arrogance. The inmate stammers, fear and distress etched on his face. "I-I didn't know," he stutters. "I didn't know we couldn't have more than one roll." I snort in disbelief. "You expect me to believe that? You should have read the handbook more closely." I reach out and snatch the booklet from his hands, flipping through the pages with a sneer. "And here it is," I say triumphantly, jabbing my finger at the relevant section. "One roll per inmate. Did you even bother to read this?" I pull the inmate out of his cell, dragging him along behind me as I stride purposefully down the hallway. "Lockdown for five days," I snap, my tone leaving no room for argument. "Maybe you'll learn to follow the rules next time." I stride out of the prison gates, my uniform crisp and my badge shining in the sun. It's been a hard day, but I've managed to keep the inmates in line, as I always do. The weight of the day's events still heavy on my mind, I pull out a pack of Marlboro reds and light one up. The smoke fills my lungs and I let out a long exhale, feeling a sense of relief wash over me. Driving down the winding country roads, the sun beating down on my face, I can't help but feel a sense of peace. The green pastures and fields stretch out for miles on either side of the road, and I feel like I'm the only one in the world. When I finally get home, I grab a cold beer from the fridge and climb into the driver's seat of my truck. The sounds of the woods and insects fill the air as I crack open the can and start to read a book. The sun slowly begins to set, casting a warm orange glow over the trees. As the night deepens, I feel a restlessness stirring within me. I decide to take my truck out for a spin, driving through the small town I grew up in. The beer has been flowing freely for hours, but it doesn't even occur to me that I might be breaking the law. I revel in the feeling of being an adult, of having power and control over others. It doesn't matter that I've spent the day punishing inmates for petty offenses, because in this moment, I am invincible. The irony of my situation is lost on me, and I continue to drive around, the night stretching out before me like an open road. After I get home and as the night wears on, I continue to drink, the bottles piling up around me. The sounds of the woods outside provide a backdrop to my drunken stupor, and I stumble out into the darkness. The insects hum around me, and the night birds call out in the distance. I feel my stomach churning, and I lurch forward, retching onto the ground. The smell of beer and bile fills my nostrils, and I heave until there's nothing left. As I stumble into the woods, their darkness and isolation seem to envelop me completely. The only witnesses to my weakness are the insects and birds, their chirping and buzzing forming a constant, mocking chorus. No god, no divine presence to judge my actions or offer me solace. I know that I can’t linger here for long. I have to be at work again at 6 in the morning, ready to continue my reign of power.

Nvidia stocks rise with AI popularity

Nvidia

Our experts tell us how the record rise in Nvidia stocks and hype around AI affected prices of cryptoassets

Nvidia has become the first graphics processor manufacturer whose market capitalization has approached $1 trillion. Its devices have recently been used by cryptocurrency miners. But now the growth of the company’s shares is due to the growth of artificial intelligence technology.
On Tuesday, May 30, price of Nvidia stocks skyrocketed to a historic high. In its quarterly report, the company said that the proliferation of artificial intelligence technology is translating into record sales. And its net income for the quarter was markedly higher than what analysts had predicted.
Nvidia’s developments have spread in the video game industry, the field of professional visualization. As well as in the field of high-performance computing and the automotive industry. In this case, Nvidia’s onboard computers are used as the basis for unmanned cars. The company supplies technology to major market players such as Apple, Microsoft, Alibaba and Amazon.
In late 2006, Nvidia allowed third-party developers to use the processing power of its graphics processing units (GPUs) not only for graphics optimization but also for other purposes. Nvidia processors are good at a lot of simultaneous calculations. And in this they noticeably lose to central processors, the leading manufacturer of which is Intel.

Notable success of Nvidia outside of the video game industry has brought the company mining cryptocurrencies. And where the GPU has also proven its effectiveness. In 2020, amid rising prices for Bitcoin and other cryptocurrencies, Nvidia surpassed Intel in market value. And its quotes continued to rise, reaching a record high of almost $330 per stock at the end of 2021.

Demand for Nvidia graphics cards was supported by miners. Who assembled cryptocurrency mining farms based on the Proof-of-Work (PoW) algorithm from the devices. The most profitable of these has always been Ethereum (ETH). But last September, developers planned to move it to Proof-of-Stake (PoS). After that, the need for mining to issue new coins disappeared. And miners were forced to switch to much less profitable coins or refused to mine cryptocurrencies using GPUs in principle.
The fall in excitement around video card mining, as well as the collapse of the crypto market last year, brought down Nvidia’s stocks. But now the wave of AI has reawakened investor enthusiasm. Since the beginning of the year, the company has increased its market share by $220 billion. By comparison, Ethereum has a market capitalization of $228.3 billion. Nvidia stock is up 165% in 2023 alone. Nvidia’s capitalization now stands at $939.3 billion, which brings it closer to the $1 trillion mark.

AI and cryptocurrencies

On May 28, Nvidia unveiled several technologies related to artificial intelligence at Computex 2023. Among them is the Avatar Cloud Engine service. Which allows you to give the intelligence of side characters in video games. As well as the DGX GH200 supercomputer for generative AI, the Spectrum-X platform for cloud providers. And the MGX architecture for creating metaverse and a few others.
The flow of news around Nvidia has also affected the cryptocurrency market. Project tokens, which aggregators categorize as “artificial intelligence,” rose in value in less than a week. And some of them showed up to 60% growth. An example of such an asset was the AKT token of the Akash Network project. The developers position it as an open network for trading computing power.
The most capitalized assets in the category also benefited from positive news from Nvidia. The token of the SingularityNET project (AGIX), “the first decentralized artificial intelligence marketplace.” Which runs on the Cardano blockchain, rose in value by 10%. Fetch.ai (FET), a coin platform with machine learning algorithms, gained more than 6% in less than a week. And the OCEAN token used by the Ocean Protocol data economy project rose nearly 9%.
Similar trends took place in the market at the beginning of the year amid the mass spread of chatbots with artificial intelligence ChatGPT. Which still enjoys notable popularity, including in the cryptocurrency community.

Largest crypto asset in AI category

The largest crypto-asset in the AI category is the Render token (RNDR) of the Render Network project from OTOY. Its capitalization exceeds $900 million and it is traded on leading cryptocurrency exchanges. And its price has risen almost seven-fold since the beginning of the year.
OTOY provides cloud-based graphics rendering solutions. These are used by visual effects creators, artists, animators, designers, architects and engineers, according to the company’s website. Its products, which also involve AI. The company Meta also uses them.
As part of the Render Network project, OTOY developers have modified the code of their cloud computing platform for GPU rendering. And they did it so that RNDR tokens could be used to pay for the service, thus creating demand for the asset.
In 2021, OTOY released the Octane X Classic rendering app on the App Store. And which also uses Render Network technology. Also getting the project into Apple’s app store was a successful marketing move for RNDR. The token has risen more than 60 percent since May 13. This happened when The Wall Street Journal’s sources reported. That Apple would unveil a mixed reality headset at the WWDC 2023 event in early June. This was largely contributed to by a number of speculations that. That the device could, in theory, also use some of the Render Network’s developments.
Our experts note that in general, the coins of blockchain projects, which in one way or another involve artificial intelligence. Since the beginning of the year proved to be the group of the most successful in terms of crypto-assets investment. Along with tokens of the management of liquid stacking services.

How to Write a Response Paper: Understanding the Basics
Writing a response paper is an important task for students. It allows them to critically analyze a text, express their thoughts and opinions, and improve their writing skills. In this comprehensive guide, our ‘write my essay’ experts will explore the basics of how to write a response paper, pre-writing steps, and crafting a winning introduction, body, and conclusion. So, let's dive in and discover a flawless response paper at the end!
Defining What is a Response Paper
A response paper is a written assignment that requires the student to read a text and respond to it by expressing their views on the topic. It can be a stand-alone assignment or part of a larger project. When writing a response paper, it is important to remember the audience you are writing for. Are you writing for your professor, classmates, or a broader audience? This will help you tailor your writing style and tone accordingly.
Moreover, this kind of academic assignment should not only summarize the text but also provide a critical analysis of its main arguments and ideas. It should demonstrate your understanding of the text and your ability to engage with it in a thoughtful and meaningful way.
Purpose of Crafting a Response Paper
Writing response papers aims to demonstrate your understanding of the text, give your opinions and thoughts, and provide evidence to support your claims. In addition, this type of paper can help you develop critical reading skills and formulate coherent arguments. By engaging with the text, you can identify its strengths and weaknesses, evaluate its claims, and form your own opinions about the topic.
Furthermore, crafting response paper examples can be a valuable exercise in self-reflection. It allows you to articulate your thoughts and feelings about a particular topic and can help you better understand your values and beliefs.
Types of Response Papers
There are various types of response papers, each with its own unique characteristics and requirements. These include:

  • Personal response: Here, you express your personal opinions, thoughts, and emotions about the text. This type of paper allows you to engage with the text more personally and explore your reactions to it.
  • Critical response: Involves analyzing, evaluating, and interpreting the text to provide a critique. This type of paper requires you to engage with the text more objectively and analytically, focusing on its strengths and weaknesses and providing evidence to support your claims.
  • Research-based response: Research-based response paper examples involve using external sources to support your claims. This type of paper requires you to engage with the text and supplement your analysis with evidence from other sources, such as scholarly articles, books, or interviews.
How to Write a Response Paper: Pre-Writing Steps
Before diving into the writing process, laying a strong foundation through effective pre-writing steps is crucial. These initial stages not only provide clarity and structure but also enhance the overall quality of your response. And if you aren’t sure how to write a reaction paper, these steps can also be employed for your assignment.

Carefully Read and Analyze the Text
The first step in response paper creation is to carefully read and analyze the text. This involves more than just reading the words on the page; it requires critical thinking and analysis. As you read, pay attention to the author's tone, style, and use of language. Highlight important points, take notes, and identify the author's main argument and themes. Consider the context in which the text was written and how it relates to contemporary issues.
For example, if you are reading a historical document, think about how it reflects the social and political climate of the time. If you are reading a work of fiction, consider how the characters and plot relate to larger themes and ideas. By carefully analyzing the text, you will be better equipped to write a thoughtful and insightful response.
Take Notes and Highlight Key Points
Another important step is to take notes while reading, as it helps you organize your thoughts and ideas. As you read through the text, jot down your reactions, questions, and observations. Highlight key points, evidence, and quotes that support the author's argument. This will make it easier to refer back to specific parts of the text when you are writing your response.
Additionally, taking notes can help you identify patterns and connections between different parts of the text. This can be especially helpful when you are trying to develop your thesis statement and outline.
Develop a Thesis Statement
A thesis statement is a central argument that you will be making in your paper. It should be clear and concise and provide direction for your essay. Your thesis statement should be based on your analysis of the text and should reflect your own perspective.
When developing your thesis statement, consider the main argument of the text and how you agree or disagree with it. Think about the evidence and examples that the author uses to support their argument and how you might use those same examples to support your own argument. Your thesis statement should be specific and focused and should guide the rest of your essay.
Create an Outline
If you want to unlock the most important tip on how to ace a response paper perfection, it lies in creating a well-organized outline. Identify key points, evidence, and arguments that you want to discuss and organize them into a well-written paper format. Your outline should include an introduction, body paragraphs, and a conclusion.
Start by introducing the text and your thesis statement. In the body paragraphs, discuss your main points and provide evidence from the text to support your argument. Use quotes and examples to illustrate your points. In conclusion, summarize your main points and restate your thesis statement. In the following paragraphs, we'll delve deeper into writing each section with more details.
Actual Writing Process with a Response Paper Format
Now that you have completed the essential pre-writing steps, it's time to delve into the actual writing process of your paper. In this section of our comprehensive guide, we will explore how to start a response paper along with developing insightful body paragraphs and culminating in a powerful conclusion.
Engage the Reader In Your Introduction
The introduction is the first impression that your reader will have of your paper. It is important to make a good first impression, so you want to engage them right from the start. There are several ways to do this, such as providing context, using a hook, or starting with a rhetorical question.
For example, if you are writing a paper about the effects of social media on mental health, you might start with a hook like:
'Did you know that the average person spends over two hours a day on social media? That's more time than they spend exercising or socializing in person.'
When working with your paper, this hook immediately grabs the reader's attention and makes them interested in learning more about your topic.
Provide Context and Background Information
Once you have engaged the reader, it's important to provide context for the text you are analyzing. This includes information like the author's name, the title of the work, and the publication date. This information helps the reader understand the context of the text and why it is important.
For example, if you are analyzing a poem by Maya Angelou, you would want to provide some background information about her life and work. You might mention that she was a civil rights activist and a prolific writer and that the poem you are analyzing was written in 1969, during a time of great social and political upheaval in the United States.
Present Your Thesis Statement
Finally, it's important to present your thesis statement in the introduction. The thesis statement is the main argument of your paper, and it should be presented clearly and concisely so that the reader knows exactly what your paper is about.
For instance, if you are crafting a response paper example about the effects of social media on mental health, your thesis statement might be something like:
'This paper argues that excessive use of social media can have negative effects on mental health, including increased anxiety, depression, and feelings of isolation.'
By presenting your thesis statement in the introduction, you are setting up the rest of your paper and giving the reader a roadmap for what to expect. This helps them stay focused and engaged throughout your paper.
Crafting the Body
One key aspect of ensuring a well-structured and articulate paper is to utilize your typical response paper outline as a reliable roadmap. By following it, you can maintain focus, coherence, and logical flow throughout your response. Moreover, keep the following points in mind as you proceed with crafting the body of your response paper:
1. Use evidence and examples from the text:
  • Incorporate relevant quotes, statistics, or other evidence that supports your opinions and arguments.
  • By using evidence from the text, you can strengthen your argument and demonstrate a deep understanding of the material.
2. Analyze and interpret the text:
  • Demonstrate your critical thinking skills by thoroughly analyzing and interpreting the text.
  • Explain how the text relates to your thesis statement and overall argument.
  • Provide a clear and concise response that showcases your knowledge and understanding of the material.
3. Address counterarguments and alternative perspectives:
  • Acknowledge and address opposing viewpoints to demonstrate your ability to consider different perspectives.
  • Explain why your argument is stronger than the opposing viewpoint.
  • Provide evidence to support your claim and solidify your stance.
Concluding Your Paper
In the conclusion of your response paper example, it is essential to consolidate your reactions, ideas, and arguments regarding the text. Summarize the key points discussed throughout your paper, drawing inferences whenever applicable.
When uncertain about how to write a conclusion for a research paper, the first important rule is to refrain from introducing new ideas or reiterating information already presented in the introduction of your paper. Instead, provide a concise and coherent summary that encapsulates the essence of your response, leaving a lasting impression on the reader.
To Wrap Up
As we conclude this comprehensive guide on how to write a response paper, you have acquired the essential tools and knowledge to embark on your writing journey with confidence. With a firm grasp of pre-writing strategies, the art of crafting an engaging introduction, organizing a well-structured body, and understanding the significance of supporting arguments and addressing counter arguments with a good response paper example, you are poised to leave a lasting impression.

2023.06.02 17:10 Wapulatus Respect Beast I, Goetia (Fate/Grand Order)

"Then I shall show you. The end of your journey. The demise of human history that will redo this planet. The moment my great undertaking is completed!"

Goetia

Shikisai ~The Time of Parting Hath Come~
This thread is a collaboration with InverseFlash and rsthethird, who helped with feat-gathering, as well as Proletlariet, who helped with formatting. Thanks!

Background

Beast I. One of the Seven Evils of Humanity, possessing the principle of "Pity".
The King of Mages, Solomon, gathered 72 demons in his life that he fashioned into "a system to promote reason in humans"--a sort of magical logic network. After some time, the demons gained self-awareness and merged into a collective being.
This being, the amalgamation of the 72 Demons, became known as Goetia.
When Solomon died, the demons were sealed away inside his corpse. The awakened Goetia at first assumed Solomon's identity. Through his eyes, they witnessed the extent of human suffering that Solomon, for all the king's vast power, had failed to address. They became disillusioned with their host, and hatched a plan to remake the world without its imperfections by travelling back in time.

Prior to revealing himself, Goetia posed as King Solomon while possessing his corpse..
Controlling Solomon granted Goetia a variety of abilities, namely the class container of "Grand", which allowed him to outclass any normal Servant by virtue of this.

It has been said that Solomon's clairvoyance can see through the past and the future.
Because Clairvoyance is a skill furnished on the flesh, Goetia can also use it.

GRAND LAST BATTLE
Despite Ars Nova ending Solomon's spell that bound the 72 Demons together, Goetia manages to linger long enough for one last fight. However, in this weakened state he can be defeated by a punch from Ritsuka.

Noble Phantasms

Ars Almadel Salomonis: The Time of Birth has Come, He is the One who Masters All

Goetia's third Noble Phantasm. The "" of original sin. A belt of light that announces mankind’s demise.
Goetia is able to manipulate this belt of light in order to collect, accelerate and converge portions of it, travelling through the timestream or otherwise influencing it.
Singularities
For his plan to work, Goetia needed to make cause and effect stop working, so he can set fire to multiple periods of time in history at the same time.
He enables this by destabilizing human history with Singularities. These are turning points in human history that he's sent Holy Grails (powerful magic artifacts) to change important historical events.

Structure/Attributes
Incineration of Human History
Once human history is destabilized, Goetia 'sets fire' to every moment of it and lets it burn. The energy is then collected as "Spiritrons" (magical energy) and raw heat.
Of course, this has catastrophic affects on the timeline.
Bands of Light
Finally, this energy is then channeled into Goetia's temple, and refined into bands of light that he can control and release at will. Either as weapons, or as fuel to for his ultimate goal: time travel to the creation of the Earth.

A Reality Marble that Goetia fabricated by amplifying the remains of King Solomon, forming a magical workshop in "void space" that exists outside the normal flow of time.
Reality Marbles are essentially self-contained dimensions that 'paint over the world' in a given area. Here's a better schematic explaining what they do.

Individual Demon Pillars - Unique Abilities

While it's likely that Goetia possesses all these abilities as the composite of all Demon God Pillars, some of his components developed wills of their own and gained unique abilities before and after his destruction at the hands of Chaldea.

Flauros

Andras

After separating from Goetia, Andras gained a self-awareness and will to live, and escaped from the Temple of Time near-death, but died afterwards. Even then, its 'vindictive desires' remained as a corpse that could maintain a being by fusing to a Heroic Spirit, summoning and doing so with Chacha and Hijikata to create a singularity-like space.

Bael

Phenex

"Huh, who would have known? ...Tragically short, and yet, strangely fascinating... So, this is what human life is..."

2023.06.02 17:04 DoomsdayWatcher [offline][5e][18+][LGBT+ friendly]Assembling a new adventuring party in London!

Looking for a group of adventurers to join a regular fortnightly in-person campaign in central London! About me 👋 • I’m Liam. 32. Scottish currently living in London. I'm a podcast producer and broadcast journalist. • Narrative focused role-play and challenging but balanced combat encounters are my speciality. I really love working with players to craft adventures around their characters. (I’m not a great puzzle master but I try every now and then!) • I’ve been working on a new campaign for a little while and I’m ready to unleash some players into the world! About the game 🎲 • Sunday afternoons from 1:30 to 5:30 in a bar in Soho from the 25th of June • I’m hoping to have a session zero prior to this (around the 20th and likely online) • I’m a pretty hands on DM and I love collaborating with players. I want all of my players to feel vital to the story of the world so happy to work with you on backstory and whatever else you need for the world. About you 🫵 • This is an inclusive game and all genders and sexualities are welcome and encouraged to come along. We're also playing in a gay bar so if that's an issue for you this group isn't right for you. • As this game will be taking place in a pub it will be an over 18s only group. • All experience level welcome, we're starting at level 1 so there will be room to grow and learn as a new player. • If you give me 1 page of backstory or motivation, I'll give you an uncommon magic item at level 1. • If you've ever wanted to try out a new build, something not optimised or more flavour than outright function, this could be the campaign for you! I'd love to have a really diverse cast of PCs. About the campaign 🐲 👑 ⚔️ • Our story will begin on the island nation of Lythoria. A long established kingdom that has maintained independence for generations. Lythoria’s unique strength comes from an alliance with the Bronze Dragons native to the island. This partnership has proven to be beneficial for both parties. It has strengthened the claim of the monarchy, boosted the military of the nation and provided protection for the dragon's natural habitat. • The PCs will begin at level 1, as new recruits to the Ashen Blade Stronghold. A clandestine organisation that trains Lythorian citizens to fulfil roles in the Queen’s court. Recruits gain entry into the organisation through lineage, nepotism or military/academic merit. Yet those with unique skill sets are often sought out to provide unique roles: a professional dancer could become a lady in waiting while also serving as an assassin or a musician could serve as a member of the court while also a bodyguard or spy. (We can have fun with this) • Session-0 will be around the 15-20th of June however I’ll work closely with you on establishing your character and provide further information once you’ve expressed interest in the game. • Player races, I’ll welcome anything from the ‘Fantastical Races’ listed in Monsters of the Multiverse, I can send you this full list if you’re interested. Eberron and Spelljammers races can be discussed but I’d probably lean away from Autognomes and/or Warforged.

2023.06.02 16:31 milkbathfortwo Landlords raising rent by 5 % and making us pay half of their repair bills

Renting in British Columbia, rent is 3900 for a 2300 square foot home, 5 bedroom, 2.5 bath.
In our agreement there is no mention of whether or not AC is provided.
The ac broke down after 1.2 years and is going to cost 25% of the price of a new unit to repair .The landlords claim they let us use it as a courtesy after we denied their proposal of shouldering half the repair bill and adding 200/month for ac maintenance, their proposal also stated that we pay the entire repair bill next time it breaks down, the AC unit is 15 years old.
We reached out May 3rd to notify about the broken AC and since then the house has reached temperatures of 83 degrees F. We could have easily found another place for July but they decided to ignore us after we denied their ludicrous request. They finally got back to us last night at 9pm, June 1st after dozens of attempted phone calls and text messages, emails looking for answers, claiming we are not to use the AC anymore and they aren’t fixing it, nor raising rent but they want us to split the technician bill of 580$. We hired a technician after two weeks of this bullshit no contact for 157 dollars. He told us there’s a leak in the system and it would be 1.5k to repair or 6k to replace, fast forward to last week, 3 weeks after notifying landlords about AC, they sent their own technician and he came to the same conclusion, exactly, only this one costed 380 dollars. The landlords now want us to split both bills, get our own indoor units and move on.
I might add that they also made us pay the water bill for the first six months until I freaked out on them for taking advantage of us. Water is usually paid for by landlords in BC. They kept the bill in their name and asked to be e transferred the exact amount.
Also out of the kindness of our hearts when they received an unexpected strata housing bill to fix the strata water system we paid their 550 dollar bill.
When we moved in the hot water tank couldn’t even support filling the friggen bath tub and we waited almost two months for a new one.
What can we do here in regards to getting our AC fixed ? Are we hooped? Can we give notice to move out in July since they squandered our time and didn’t reply until June 1st? We work nightshift and is basically impossible to sleep once it hits 28+ C .

2023.06.02 16:13 PotentialPrimary5054 Landlord is stalling on fixing a/c compressor in TX

I am looking for advice and what can be done in my circumstances. I've been renting an apartment in a small town in Texas for 18 months. Since day 1 we had maintained issues and issues with a/c in particular. On May 26th our a/c stopped working. After a long day of waiting on maintenance they estimated that it needs a new compressor. I asked them to install a/c units. Maintenance said that compressor was ordered the same day. Following Monday, I had to keep calling leasing office, they had no idea what's going on. Leasing manager told me their professional should be there to estimate if it needs a part or a full compressor, but they don't know if he actually showed up. I've sent them a certified letter stating that if the issue won't be fixed within 7 business days I will be seeking to break a lease. Ideally, without paying penalty on a leasing agreement. That's when their manager went ballistic and rude and said that they provided me with reasonable accommodations. I've checked with the city and they have no codes on tenants/landlord (I figure bc it's a small town). Leasing office will not decrease my rent based of no access to central a/c. Neither give me any updates. Window units will not work when it will hit 100 in Texas. My leasing agreement has no paragraph on A/C whatsoever. I dont have extra money to pay for breaking the lease, neither i think it's fair. What are my options?
